New York Attorney General Letitia James, a Democrat, on Wednesday took the dramatic step of filing a lawsuit against former President Donald Trump and his three grown children, accusing them of undervaluing their assets to get better rates on loans, insurance policies and taxes.

James’ lawsuit is a civil case, not a criminal one. That and to prohibit Trump, Donald Trump Jr., Ivanka Trump and Eric Trump from being executives of any company in New York, or to prohibit the Trump Organization from purchasing any commercial real estate or obtaining loans from financial institutions in New York for five years.

The lawsuit is the result of a years-long investigation into James and comes less than 50 days before the midterm elections.

Trump’s lawyer, Alina Habba, said the lawsuit is not focused on the facts, nor the law.

“[R]besides, it is focused exclusively on advancing the political agenda of the state prosecutor. It is quite clear that the Prosecutor’s Office overstepped its legal authority by getting involved in transactions where there was no wrongdoing,” Habba said in a statement.

“We are confident that our justice system will not withstand this unchecked abuse of power and we look forward to defending our client against any baseless claims by the Attorney General,” she said.

Donald Trump Jr. was more specific, tweeting, “The crappy Democrat witch hunt continues!” His tweet followed a video of James vowing to sue Trump.

Trump Jr. also tweeted another video of James calling Trump an “illegitimate president” and saying he was looking forward to “sueing him and going home.”

She also called him an “existential threat” and “crazy.”

“This president is an existential threat to all of us in this room … the number one issue in this country is the defeat of Donald Trump. Nothing else matters,” she said.

Rep. Jim Banks, chairman of the Republican Study Committee, called James “desperate.”

“AG Letitia James campaigned to impeach President Trump and is now desperate to keep that promise. “For the sake of our nation, I hope that House Democrats and President Biden will come to their senses and condemn this illegitimate fishing expedition,” he said in a statement.

“House Republicans will hold partisan actors posing as law enforcement agents accountable for abusing their power when we retake the majority,” he added.

New York GOP Chairman Nick Langworthy called the lawsuit “brazen political publicity.”

“Tish James’ civil suit against the Trump family 49 days before the election is one of the most blatant political publicity stunts I’ve seen in my lifetime. Recent polls confirm that voters are abandoning her and her fellow Democrats in droves, and as we’ve seen time and time again from New York Democrats, they have no problem breaking laws or trampling on our constitution to try to hold onto power,” he said, adding:

Day after day, Tish James ignores the blatant corruption of her fellow Democrats and the crime wave that has beset our country. She dealt with her own office corruption, political attacks on rivals, and her relentless obsession with not only the president, but his entire family is disgusting. This lawsuit is not worth the paper it is written on and voters of all races should be deeply disturbed by this reckless abuse of power used solely for political gain.

According to The Washington PostJames is suing for more than $250 million and has referred possible violations of federal law to the Justice Department and the IRS.

In addition to Trump and his children, the lawsuit names the Trump Organization and business executives Allen Weisselberg and controller Jeffrey McConney.
